Dmitry Nekrestyanov was recognized as «Lawyer of the year» by «Delovoy Peterburg»
The results of the newspaper “Delovoy Peterburg” rating “Lawyer of the year-2018” were summed up: Dmitry Nekrestyanov, Partner, Head of Real Estate and Investments Practice of Kachkin and Partners held the top spot.
The project, noted by professional and journalistic community as the best, was a prolonged dispute between city defenders and Gosstroynadzor about allowing the residential complex “Planetograd” three buildings’ construction near the Pulkovo Observatory, and also recognizing the territory planning project illegal.
The St. Petersburg City Court declared the territory planning project illegal, then the Kuybyshevsky District Court and the St. Petersburg City Court declared the building permit illegal. The turn in court proceedings coincided with the involvement of Kachkin and Partners’ experts in protecting the interests of the developer: almost complete loss was replaced by an incredible result — the cassation instance of the St. Petersburg City Court declared illegal the cancellation of the building permit, and the Supreme Court recognized the planning project as legal.
“We got involved when courts’ negative decisions had already been taken, and one even came into force, a number of judicial opportunities were lost. The victory in this dispute is a team success, a whole group of lawyers worked on the task. First, in the Supreme Court, and then in the Presidium of the St. Petersburg City Court, it was possible to prove the illegitimacy of the decisions made by the lower instances, and this radically changed the situation”, comments Dmitry Nekrestyanov.
