Defending client’s interests in a dispute over the collection of back debt in an amount exceeding EURO 300 K

Our client, Nord-Metall LLC, a leader in the sale of rolled metal products in St. Petersburg, is a supplier of ferrous-metal scrap and waste for a subsidiary of one of the main engineering rolled product producers in the Russian Federation and the CIS countries. At present, the amount of debt due and owing to Nord-Metall LLC and the entities forming our client’s group of companies totals more than EURO 300 K.

Previously, with the assistance of attorneys from Kachkin & Partners, a dispute between the companies over an amount exceeding EURO 1 mln was settled amicably – more than half of the debt was repaid to the client during court proceedings, with the remainder covered by an amicable settlement stipulating debt repayment within three months – with the result that the debt owed to our client was repaid in full, and supply cooperation between the companies was able to continue.

At present, based on an application filed by one of the creditors, the debtor has been declared bankrupt, and the claims of our client’s companies have been included in the register of creditor claims. Despite the fact that the voting majority at the creditors’ meeting is held by a creditor affiliated with  the debtor, the Kachkin & Partners team has developed an action plan designed to protect the interests of our client in the matter of the debtor’s bankruptcy with the aim of recovering the debt, and is taking active part in the bankruptcy proceedings.
