Kachkin & Partners, Attorneys at Law successfully represented in court the interests of the owners of the Eliseev’s Shop at Nevsky prospect of St. Petersburg

Kachkin & Partners’ lawyers represented «The Eliseev’s Shop» LLC within the claim for St. Petersburg City Property Management Committee on compelling to charge on the rental account the sum of more than 115 mln roubles spent for the restoration of the federal cultural heritage site – the Eliseev’s Shop at Nevsky prospekt.

After carrying out the costly repair of the Eliseev’s shop with the restoration of its fascinating interiors the lessee received the Committee’s agreement for charging the cost on the rental account. Nevertheless, after the estimate of the performed repair had been made up, the lessee reached a bureaucratic deadlock. The reason for this was probably in the substantial price of the performed repair.

This victory came as the result of consequent review of two arbitration cases. Last year the court recognized the liability of the Ministry of Culture of the Russian Federation to reconcile all the repair estimates. This time Kachkin & Partners’ lawyers managed to compel St. Petersburg City Property Management Committee to directly carry out the actions on charging these expenses on the rental account. The fact that there’s a legal gap in St. Petersburg legislation regarding the opportunity of charging expenses for repairing federal monuments because they aren’t commonly owned by St. Petersburg added complexity to this dispute.
