Representing Adamant, a large development holding, at court

Kachkin & Partners lawyers successfully represented Adamant, a large development holding, in processing of its rights for the building of a business centre located in historical part of St. Petersburg. The object of more than 17 th sq m was created on the basis of a reconstruction agreement made on investment terms with the city authorities.

The client instructed Real Estate and Investments associates’ team of Kachkin & Partners under the guidance of the firm’s partner Dmitry Nekrestyanov on filing a lawsuit in court according to refusal of St. Petersburg City Property Management Committee to sign a protocol on fulfillment of investment terms with reference to bureaucratic notes to the submitted documents. The matter’ complexity was connected with changes in legislation and legal situation at the object during its reconstruction and necessity to take into consideration the building’s peculiarities as a historical monument.

Kachkin & Partners lawyers managed to assert at court that all the investor’s obligations had been fully answered and declare the holding’s ownership of the business centre. Moreover, due to their competent actions the experts could convince court of unlawfulness of the City Property Management Committee requirements of supplemental payment of more than 50 mln roubles of additionally charged investment deductions that might have significantly influenced the project’s economics.
