Representing interests of a large Russian general contractor STEP LLC in a court dispute with a customer Pharmasintez-Nord JSC regarding a payment for the performed work and related claims on a total sum exceeding RUR 100 mln was successfully completed with the approval of settlement agreement
A large Russian general contractor STEP contacted us in the context of a rapidly progressing dispute with a customer, who had ordered construction of a research-and-manufacturing complex for medicine development and production in St. Petersburg in the context of the expected early termination of the general contract .
Together with the client, Kachkin & Partners’ experts developed a strategy of actions taking into account possible future court proceedings, including pre-trial preparation and a court claim.
Traditionally, the dispute between the parties was accompanied by unsigned acts of acceptance of the work results, a dispute on the quality of the performed work, presence of additional work and a dispute on meeting the deadlines and quality of the original documentation provided by the customer. In addition, it was complicated by a significant amount of documentation and the rapid progressing of operations on the construction site.
As a result of the developed strategy, the client successfully completed the pre-trial stage of work with the documents and correspondence, so that even before the start of the hearings in the arbitration court more than 90% of the client’s requirements were satisfied by the customer. The remaining unsolved issues between the parties were fully resolved as a result of negotiations conducted by Kachkin & Partners’ experts and the client within the framework of the settlement agreement adjusted by the parties, which was approved by the court. The completion of the case allowed the parties to result the dispute without additional financial and reputational losses that inevitably arise from complex and lengthy contractual litigation.
