Defense of a major IT-company BIA Technologies rights to service intellectual property assets

BIA Technologies, a large company specializing in development of interactive applications for automation of business processes, applied to Kachkin & Partners to defend its intellectual property rights to assets created using its own labor resources.

At the client’s instruction Kachkin & Partners lawyers performed a comprehensive legal audit of company’s business. Special attention was paid to assessing processes of intellectual property assets development by client’s staff (PC software, databases). Kachkin & Partners lawyers requested and analyzed documents registered between the client and its staff (employment agreements, assignments, occupational instructions) and internal local regulations (Regulations on Works Made for Hire, Confidentiality Regulations).

Following the results of the completed legal audit we prepared a detailed legal opinion, which both assessed extent of applied document forms defending client’s interests as an intellectual property right holder and proposed recommendations on their improvement in order to mitigate risks of employees disputing rights to intellectual property.
