Defending the intellectual property rights in an domain name dispute

Our client, a service company, sought court defence against their intellectual property rights violators who registered a domain name containing a secured commercial name belonged to our client. The Federal Antimonopoly Service refused to satisfy the claim and cease the IP rights violation; the refusal was then appealed in court.

Following the negative court decision, the client instructed Kachkin & Partners to represent their interests in further proceedings. Our lawyers assessed the case perspective, which was relatively poor, and suggested filing simultaneously a separate claim against the violator to the commercial court.

This strategy is now implemented, proceedings are ongoing.
