Protection of the toy store interests in the dispute over violation of the exclusive right for the trademark “Masha and the Bear”
Kachkin & Partners experts were contacted by the owner of the children’s toys store, engaged in retail sales, with the task of representing his interests in a lawsuit with Masha and the Bear Ltd. about violation of exclusive rights for trademarks «Masha and the Bear», «Masha», «Bear», as well as copyrights to the characters with the same names. After the control purchase, Masha and the Bear Ltd. demanded compensation from the Individual entrepreneur for violation of exclusive rights for three trademarks at once, consisting in the sale of a children’s tablet on which the characters of the cartoon Masha and the Bear were depicted.
Lawyers prepared a statement of defense with a reasoned position regarding the disproportionate compensation claimed and justification of failure of evidence of the illegal use of trademarks.
In addition lawyers of Kachkin & Partners held a number of negotiations with representatives of the claimant, which resulted in the dispute being resolved by conclusion of a settlement agreement, according to the terms of which the amount of compensation requested was halved.
