The article views the limits of legal incapacitation by the example of a non-compete clause in a commercial concession agreement. Ekaterina Smirnova, Corporate and Dispute Resolution Practice Associate at Kachkin & Partners, answers the question whether the non-compete clause can be used in Russia adjusted to the local antitrust regulations. She also analyses the limits of incapacitation set by the Russian law and provides relevant examples from foreign law. Detailed attention is given to the limits of incapacitation set by the Russian law for commercial concession agreements (franchise agreements).
