«Museums against copyright»
In her article Ekaterina Smirnova, Corporate and Dispute Resolution Associate at Kachkin & Partners, reviews the dual legal status of extra valuable works of art, analyzing the museums’ right to prohibit or to allow the use of museum exhibit items and how this right is related to copyright. The main question that this paper addresses is whether there is a collision of Article 1282 of the Civil Code of the Russian Federation and Article 36 of the Federal Law «On the Museum Fund and Museums in the Russian Federation» and how this collision can be resolved. She also looks into the policies of Russian and foreign courts on the issue.
