Protecting interests of a large equipment supplier for Oil and Gas industry
Our client, «HydromashService», is one of the leading companies specializing in integrated equipment supplies for Oil and Gas, Water and Utilities, Thermal and Nuclear Energy, Steel and Mining, Chemical processing and Shipbuilding. In 2012 it was charged by the buyer, «Transneft» group company, for slow equipment delivery. The sum of the forfeit was written off the Hydromashsrvice’s bank account as was guaranteed by the bank; moreover, the company was claimed for damages not covered by the bank guarantee. Total claims amounted to RUB 27 million.
Our lawyers filed a claim in the court to recover the written-off forfeit. The claim was incorporated into the legal proceedings initiated by the opponent. We proved that the delay in the equipment delivery happened due to the fault of the Buyer. The court held that the Buyer breached some of the contract terms which made the supplier unable to deliver the equipment on the due date. Thanks to the smart strategy in conducting the case and the proposed body of evidence, total claims were deemed as inconsistent with the consequences of breach of obligations and reduced by more than 46 times.
