Defending the warrantors
A client of Kachkin & Partners, a group of shareholders of a Russian company (LLC) possessing valuable real estate assets (commercial real estate valued over USD 16 m), acted as warrantors on a loan of app. USD 1,6 m. As the lessee failed to pay out the loan according the schedule, the creditor sought to enforce security and get the shares possessed by the warrantors. They succeeded in applying interim measures resulted in prohibition on and deal with the real estate property described.
Kachkin & Partners successfully challenged the interim measures before court in just 1 instance. Our experts also, by the client’s request, mediated the out-of-court settlement of dispute between the creditor and the debtor, drafted the settlement agreement and secured the approvals and signing.
