Representing LAM Electric Installation Company acting as defendant in three closely connected commercial disputes arising from construction works
Several interconnected claims in relation to the construction of transformer switching station for one of the largest hypermarkets in St. Petersburg were filed against our client by its customer and sub-contractor. By the moment Kachkin & Partners was retained as counsel, the court of the first instance had already ruled in favor of plaintiffs. The ruling was based on a solid set of numerous expert opinions supporting the plaintiffs’ position. Another factor of the complexity incurred was related to the faulty technical documentation used in the sub-construction contract. The overall amount of damage claims filed against the defendant twice exceeded the contract value.
We managed to develop a new strategy for the court appeals involving new set of evidence proving the defendant’s arguments. As a result, all the claims against our client totaled over 17 million Rubles were rejected. Furthermore, the defendant filed a successful counter-suit for damages. The rulings in favor of the client entered into force, including the ruling in the counter-claim for RUB 1M.
