Kachkin and Partners experts considered peculiarities of the federal law on private-public partnership at the enlarged meeting of the working group on PPP of the Strategic Partnership «North-West»
An enlarged meeting of the PPP working group of the Strategic Partnership «North-West» took place at the residence of Presidential Plenipotentiary Envoy to the Northwestern Federal District. The session was devoted to the topic: «PPP in a new format: a challenge for the authorities or the delegation instrument?»
The focus of the attention turned out to be the federal law «On private-public partnership, municipal-private partnership in the Russian Federation and the amendments to certain legislative acts of the Russian Federation», adopted on July 13th, 2015 and going into effect on January 1st, 2016.
Denis Kachkin, head of the working group, the Managing Partner of Kachkin & Partners, and Maria Skryabina, Infrastructure and PPP Associate at Kachkin & Partners, took an active part in the event by performing with reports. The experts made a comparative analysis of the concession model and the PPP agreement, pointed out the need for setting a regulatory framework for the implementation of successful regional policy in the field of PPP, drew attention to the existing imperfections in the new law.
The participants also discussed whether the legislative innovations can become a driver for infrastructure development in the regions. The experts presented recommendations for regional authorities and municipal governments on modernization of regional legislation, designation of the authorized body and PPP control system, introducing of mechanisms to assess the projects’ effectiveness. Besides, the event’s speakers touched upon organization of competitive selection process, building relations with investor and credit organizations and effective project management at all stages of the life cycle.
Following the meeting the main comments and proposals to the federal law were prepared. Taking them into account, the document is planned to be submitted to the Ministry of Economic Development and the State Duma of the Russian Federation.
Among the speakers and attendees of the meeting were representatives of the regional authorities responsible for economic development and investment attraction from more than 15 subjects of the North-West region of the Russian Federation; leaders of major business; consulting firm experts and the banking community.
