Legal support for the participant in a tender for the right to conclude a concession agreement on highway construction
Kachkin & Partners was providing legal support to Regional Concession Company LLC (a consortium of one of Russia’s largest banks – Gazprombank, international investment group RISE Capital and Sibmost OJSC – Russia’s leading roadbuilding company), which is participating in a tender for the right to conclude a concession agreement on the construction of the “Khabarovsk km 13 – km 42 Bypass.” The scope of services being provided included, among other things, assistance in preparation of the bid, participation in negotiations with the counterparty at the agreement-conclusion stage, and support for financial closing.
Pursuant to the proposed agreement, which would be concluded for a term of 15 years, the private investor is expected to develop the highway site and provide for its maintenance and operation. Vehicle travel along the highway will be toll-based.
The project is aimed at supporting the intensive infrastructure development of Russia’s Far East. It is anticipated that the highway will not only make it possible to organize the flow of transit traffic in a way that bypasses Khabarovsk (the largest industrial, economic, scientific, cultural and administrative center of the Far Eastern Federal District, with a population of 600,000), but also serve as a springboard for the creation of a new transportation system with the People’s Republic of China.
